General Election Ballot

(d) A ballot shall be sent to the members to determine each member’s preferences among those seeking election. The form of the ballot shall read as follows:

Recommendation for Election to Judicial Office __________________________ (General Election)

Does candidate ___________________________, seeking nomination for election to be a judge of the ____________________ Court, have the integrity, temperament, industry and professional competence to be a good judge, which deserves the support and recommendation of the Parma Bar Association?

The Committee on Judicial Candidates shall mail said ballot no later than one hundred-twenty (120) days prior to the general election. All responses to said ballot must be received by the Committee on Judicial Candidates from the membership no later than ninety (90) days prior to the general election. Any candidate receiving an affirmative vote of 65 percent of the votes cast by the members shall then receive the recommendation of the Association.

(e) In the event that no candidate receives an affirmative vote of 65 percent of the votes cast by the members voting in such election, then the Association shall make no recommendation for that judicial office.

(f) The provisions of the Article 14 shall be the sole method or recommending or in any form endorsing judicial nominees or candidates. However, notwithstanding the provisions in the Article 14 for voting on recommendation of nominees and candidates for judicial offices, the Board of Trustees is empowered in unusual circumstances which may arise from time to time, and which make following the provisions of (a) through (e) impossible or impractical, to establish an alternate plan for determination of judicial recommendations by the Association provided that such plan shall provide for polling all the members of the Association and shall be approved by not less than two-thirds (2/3) of the Board of Trustees.

ARTICLE XV – Solicitors And Law Directors

In all primary and general elections for those offices to which only members of the bar may be elected, within the jurisdiction of the Parma Municipal Court, the Committee on Judicial Candidates, in accordance with the procedures set forth in Article 14, shall conduct a poll among the members of the Association to determine their preference of candidates, and recommendations for nomination and endorsements for election shall be similarly made.

ARTICLE XVI – Amendments

(a) Proposals to amend this Constitution shall be submitted first to the Board of Trustees either by a resolution in writing introduced by any member of the Board or by a proposal in writing submitted to the secretary and signed by not less than ten percent (10%) of the members of the Association. Thereafter, the Secretary shall notify the members of the Board of Trustees that such a proposal has been submitted to the Board for approval or disapproval at a meeting to be held not less than two (2) weeks nor more than four (4) weeks after the giving of such notice. The Board of Trustees shall indicated their approval or disapproval by a vote of the majority of the members present at such meeting.

(b) After the Board has passed upon such proposal, the Secretary shall notify by mail all members of the association that the proposal will be submitted to a vote of the members either by mail or at a designated meeting of the Association to take place within a period of thirty (30) days following the mailing of such notice. Before voting upon such proposal, the members shall be notified of the action taken by the Board of Trustees with respect thereto. An affirmative vote of two-thirds (2/3) of the members who cast their ballots with respect to such proposal shall be sufficient to adopt the same.

(c) The notice required to be sent to each member of the Association concerning such amendment shall state in writing the exact language of the proposed amendment.
